RULES AT A GLANCE
Our rules and regulations are put in place to preserve the beauty, tranquility and safety of our neighborhood and are for the benefit of all homeowners. In addition to the following rules, also refer to the Association’s Declaration of Covenants, Conditions and Restrictions (the Declaration), our By-Laws and Articles for a complete description of Whisper Dunes restrictions. These are available on our web portal or from our Property Management Company. In the event of any conflict between the Declaration and these Rules and Regulations, the Declaration shall be the controlling document.
MODIFICATIONS
All changes to the exterior of your home or Lot must have an architectural review and be approved by the board before the changes are made. These include, but not limited to, screen enclosures, patio pavers, changing paint color, adding gutters, fences, storm doors, lighting or any landscaping on any portion of the Lot. It is the responsibility of the Architectural Review Committee (ARC) to preserve, enhance, and assure uniformity in the architectural aesthetics of the Whisper Dunes community by consistently applying the Covenants and Design Standards. POOL RULES
The community swimming pool and cabana are for the use of owners, tenants and guests and shall not be reserved for private parties or large gatherings. Pets, bicycles, skateboards, roller blades, skates, remote controlled vehicles of any type are not allowed in the community swimming pool and cabana area. Children under fifteen (15) years of age must be accompanied by a person over eighteen (18) years of age. Infants shall wear swim diapers. No glass containers or smoking is allowed in the community swimming pool and cabana area. No running or diving is allowed. No food shall be allowed within four (4) feet of the community swimming pool. No loud or offensive music shall be played. Pool hours are from 6:00 a.m. to 10:00 p.m. (local time). CC&Rs 10.32.1
TRASH CONTAINERS
All trash containers are to be stored in the garage so that they are not visible from any adjoining lot or street. Nates Sanitation serves Whisper Dunes as our recommended trash service. Trash containers should be put on the curb after 5:00PM the evening before pickup and returned to the garage on the same day it is collected. CC&Rs 10.19
Trash pickup days for Whisper Dunes are on Tuesdays & Fridays.
VEHICLES & PARKING
Vehicles should be parked in the garage or the driveway of your property or in other parking areas designated by the Association. Because guest parking may be limited in some areas, each Owner is specifically cautioned that they and the occupants of their Residence may be limited or restricted as to the number of vehicles they may park or store on the Property. No on-street parking will be permitted unless for special events approved in writing by the Association. Villa Motor Courts have specific restrictions. CC&Rs 2.13, 10.23; Guidelines-Parking
Commercial, inoperable, recreational, trailers, boats and other watercraft, may not be parked, kept or stored on any lot, or street unless stored or placed within the garage or screened from view of the general public. If you need an exception for a short period of time, use the Contact MANAGEMENT/BOD form to request permission.
"Commercial Vehicle" means any vehicle, which from viewing the exterior of the vehicle or any portion thereof, shows any commercial markings, signs, logos, displays, tool racks, saddle racks, or other elements of a commercial nature or otherwise indicates a commercial use. CC&Rs 10.22.2
PETS
Homeowners are allowed 2 household pets per lot. Dogs and cats are not allowed to roam free. They are to be restrained at all times. All residents are required to pick up after their pet. For your convenience, there are dog waste stations located throughout the community. Stations are serviced regularly and are for dog waste only. Cat litter must be disposed of with household trash and not tossed into pet station containers. CC&R 10.16
SIGNS & FLAGS
Signs & Flags. Signs are not permitted on any Lot. Signs are not permitted in windows that can be seen from the street, sidewalk, or neighboring residence. The only sign permitted is a single sign for purpose of advertising the sale of Residence. Signs must be taken down no later than the day of closing. Open House signs shall be in the yard of the home and in the Lighthouse roundabout only and immediately removed after the event and/or at night. CC&Rs 10.17
Flags: A flagpole for only the American flag attached to the building is allowed. Any flag, other than the American flag, including but not limited to sports, welcome, garden, school, etc., is limited to one (1), may not be more than 14”x20” and must be placed in the landscaping bed or on the front porch. HOLIDAY LIGHTING & DECORATIONS
Holiday lighting and decorations are permitted to be placed upon the exterior portions of Residences and upon Lots in the manner permitted hereunder, beginning October 15th and removed not later than January 15th of the following year.
No lighting, facilities or electrical cords or any decorations shall be permitted to be placed on or across any
grass area maintained by the Association. The HOA and its agents shall be permitted, but shall not be required, to remove any such items which serve as impediments to the mowing of the grass. The Owner, by placement of any lighting or decorations, assumes the risk that such lighting and decorations may be inadvertently damaged or destroyed. An Owner shall be permitted to place holiday lighting and decorations on and within the shrubs located in the front yard of the Lot, provided that (i) the Association shall not be required to maintain such shrubs for such period of time as the decorations, lighting and cords are contained within the shrubs, and (ii) such placement shall not otherwise interfere with the mowing of the grass on the Lot by the Association (if any).
Except for the foregoing seasonal holiday lights, and any exterior lighting initially installed by the one the community developers or the Association, no spotlights, flood lights or similar high intensity lighting shall be placed or utilized upon any Lot which in any way will allow light to be reflected on any other Residence or upon the Common Area or any part thereof.
